whether-to undertake additional projects not on the "A" or "B" lists, or whether to proceed to <br /> premature Consent Decree termination pursuant to Section IX. <br /> 13. Additional Remedaation Measures In the event that the Permit Termination <br /> criteria of paragraph 14 below are not met following completion of all the mitigation projects <br /> on both the "A" and "B" Lists, within sixty days after the Division notifies SGC of such a <br /> determination, SGC may notify the Division of its intent to propose additional remediation <br /> projects which are anticipated to have a positive impact on the water quality of the Animas <br /> River. SGC will submit Work Plans for such projects to the Division within a reasonable <br /> time. These Work Plans will be in substantially the same form and will contain all of the <br /> types of information contained in the Work Plans approved by the Division for the projects <br /> listed in Appendix B. Within sixty days of SGC's submittal of Work Plans, the Division will <br /> notify SGC whether it approves or disapproves such Work Plans, and if it disapproves, will <br /> state its reasons. The Division will not unreasonably withhold its approval. If additional <br /> projects are approved, a permit for such projects will be issued by the Division. <br /> 14. The Division will determine that there has been a Successful Permit <br /> Termination Assessment if all of the following criteria are met: <br /> a. Five years have elapsed from the date of valve closure at the American <br /> Tunnel property line plug- <br /> b. Two years have elapsed since notice of mine pool equilibrium has been <br /> given pursuant to Paragraph 9. <br /> J"JJ-,.2a&% 21 <br />
