1 <br /> the water quality control program adopted pursuant to the Water Quality Control Act, C.R.S. <br /> § 25-8-101 (1989) ("Act"). <br /> WHEREAS, SGC owns an inactive mining property in San Juan County, Colorado, <br /> near the City of Silverton, commonly referred to as the Sunnyside Mine ("Mine"). <br /> WHEREAS, SGC undertook mining operations at the Mine for approximately six <br /> years, from 1985 to 1991, although the Mine has operated under other owners for many <br /> decades. <br /> WHEREAS, SGC holds two Colorado Discharge Permit System ("CDPS") permits <br /> authorizing the discharge of pollutants from the mine, in accordance with numeric effluent <br /> limits and other conditions. CDPS Permit No. CO-0027529 authorizes the discharge of Mine <br /> water through the Mine's main access portal, commonly referred to as the American Tunnel, <br /> to Cement Creek. SGC does not own all of the property drained by the American Tunnel. <br /> CDPS Permit No. CO-0036056 authorizes the discharge of Mine water through a secondary <br /> access portal, commonly referred to as the Terry Tunnel, to Eureka Gulch. SGC continues to <br /> be bound by the terms and conditions of its CDPS permits and continues to treat Mine water <br /> flows. Treatment includes creation of treatment residues which are periodically dredged and <br /> disposed of at SGC's existing tailings pond. <br /> WHEREAS, SGC holds CDPS Permit No. CO-0000426, for the Mayflower Mill, <br /> which authorizes the discharge of pollutants from the Mayflower Mill tailings piles to the <br /> Animas River in accordance with numeric effluent limits and other conditions. <br /> 3"11-1.7/19,96 2 <br />
