k. "Work" means all remedial, mitigative, corrective, and other actions, <br /> schedules, plans, terms, and conditions prescribed by or described in this Consent Decree, <br /> documents appended hereto, and any future amendments hereto. <br /> 1. "Work Plan" means any one of the plans for remedial or mitigative <br /> work, either attached to the permit for mitigation projects which is attached as Appendix C to <br /> this Consent Decree, or submitted by SGC to the Division for approval pursuant to this <br /> Consent Decree. <br /> in. "WQCD" means the Water Quality Control Division of the Colorado <br /> Department of Public Health and Environment. <br /> IV. COMMITMENTS OF THE PARTIES <br /> 5. Performance and Financing of the Work SGC will perform, or cause to be <br /> performed, the Work agreed to in this Consent Decree. SGC may undertake any portion of <br /> the Work through qualified consultants or contractors designated by SGC, provided that no <br /> such designation will relieve SGC of any of its obligations under this Consent Decree. SGC <br /> will timely finance the Work. SGC will complete the Work in accordance with the <br /> Reclamation Standards of the Colorado Division of Minerals and Geology ("DMG") and the <br /> Work Plans. <br /> a. SGC will reimburse to the State of Colorado the actual costs for time <br /> spent for inspection of the Work performed pursuant to the Consent Decree at a rate of $33.33 <br /> per hour, and associated expenses, up to a maximum of$3,100 per mitigation project.
