<br />The Applicant, The Reynolds Mining Company, a Limited
<br />Partnership of the State of Colorado, by and through their
<br />attorney, W. B. Tourtillott, Jr., 802 Capitol Life Center,
<br />225 East 16th Avenue, Denver, Colorado 80203, and requests
<br />a water storage right for domestic, fire protection, mining,
<br />milling, and power purposes. Filed December 3Q, 1976.
<br />No opposition has been filed.
<br />Applicant filed a Motion to correct or in the Alternative
<br />a Protest of the Ruling of Water Referee entered March 8, 1979
<br />setting forth as grounds that the location of Lake Reservoir
<br />is in Ouray County, Colorado and the source of water is Sneffles
<br />Creek, tributary to the Uncompahgre River as republished in
<br />November, 1978.

<br />FINDING OF FACT
<br />The Lake Reservoir has as a source of water supply Snefflea
<br />Creek, a tributary of the Uncpmpahgre River in Ouray County in
<br />the old Water District No. 68.
<br />Said Reservoir is described as being located in accordance
<br />with a map and statements No. 5049 filed with the State Engineer
<br />on August 20, 1908. Point of discharge is located at a point
<br />whence Corner Number 3 of Survey Number 1318B, Mt. Sneffels Mill
<br />Site bears North 57° East, 295 feet in Section 21, Township 43
<br />North, Range 8 West of the N.M.P.M.
<br />Said Reservoir has a dam 13 feet in height, 333 feet in
<br />length, and a total storage capacity of 24.74 acre -feet, 23.55
<br />acre -feet of which is active capacity and 1.19 acre -feet which
<br />is dead storage.
<br />24.74 acre -feet of storage water is claimed for domestic,
<br />fire protection, mining, milling, and power purposes as of
<br />appropriation date of September 12, 1905, when it was first
<br />used for the stated purposes by the Mt. Sneffels Mill.
<br />RULING
<br />IT IS THE CORRECTED RULING OF THE REFEREE that water has
<br />been appropriated and applied beneficially and that the Lake
<br />Reservoir is APPROVED AND GRANTED AN ABSOLUTE DECREE for the
<br />use and benefit of the parties lawfully entitled thereto for
<br />an amount of storage not to exceed 24.74 acre -feet for domestic,
<br />fire protection, mining, milling, and power purposes with a
<br />1976 Priority and an appropriation date of September 12, 1905.
