Tourtillott, Jr., 802 Capitol Life <br />Center, Denver, Colorado 80203, applies for a non - tributary water <br />right underground. Filed December 30, 1976. <br />Opposition has been filed by the United States of America, <br />c/o Hank Meshorer, Department of Justice, P.O. Box 1656, Denver, <br />Colorado 80201, cldiming adverse affect of the rights of the United <br />States of America. Filed February 28, 1977. <br />Applicant filed a Motion to correct or in the Alternative a <br />Protest of the Ruling of Water Referee entered May 4, 1979 setting <br />forth as grounds that the location of Revenue Virginius Mine is in <br />Ouray County, Colorado and the source of water is Sneffles Creek, <br />tributary to the Uncompahgre River as republished. <br />FINDING OF FACT <br />The Revenue Virginia Mine Water Works has as a source of water <br />supply discharges from the mine portal from ground waters developed <br />through the mining operations by the Applicant and its predecessors <br />and tributary to Sneffles Creek, which is a tributary of the Uncompahgre <br />River. <br />The point of diversion is described as being located in the <br />NE 1/4 SE 1/4 of Section 21, Township 43 North, Range 8 West of the <br />N.M.P.M. <br />3.34 c.f.s. or 1,500 g.p.m. of water is claimed for mining, <br />milling and industrial purposes as of the original use of said water <br />for that purpose in 1934, and for commerical, piscatorial, recreational, <br />fire protection, municpal and domestic purposes as of the date of this <br />application, December 30, 1976. <br />EXHIBIT A <br />
