The Applicant, the Reynolds Mining Company, c/o their attorneys,
Martha Phillips Feiten and W.B. Tourtillott, Jr., 802 Capitol Life
Center, Denver, Colorado 80203, applies for a non - tributary water
right underground. Filed December 30, 1976.
Opposition has been filed by the United States of America,
c/o Hank Meshorer, Department of Justice, P.O. Box 1656, Denver,
Colorado 80201, cldiming adverse affect of the rights of the United
States of America. Filed February 28, 1977.
Applicant filed a Motion to correct or in the Alternative a
Protest of the Ruling of Water Referee entered May 4, 1979 setting
forth as grounds that the location of Revenue Virginius Mine is in
Ouray County, Colorado and the source of water is Sneffles Creek,
tributary to the Uncompahgre River as republished.
FINDING OF FACT
The Revenue Virginia Mine Water Works has as a source of water
supply discharges from the mine portal from ground waters developed
through the mining operations by the Applicant and its predecessors
and tributary to Sneffles Creek, which is a tributary of the Uncompahgre
River.
The point of diversion is described as being located in the
NE 1/4 SE 1/4 of Section 21, Township 43 North, Range 8 West of the
N.M.P.M.
3.34 c.f.s. or 1,500 g.p.m. of water is claimed for mining,
milling and industrial purposes as of the original use of said water
for that purpose in 1934, and for commerical, piscatorial, recreational,
fire protection, municpal and domestic purposes as of the date of this
application, December 30, 1976.
