sgccd.7kr <br />1/27/96 <br />12 <br />The Reference Point shall not be a <br />permit compliance point. <br />7. Monitoring and Completion. SGC shall perform the monitoring described in <br />paragraph 10, and, unless this Agreement is prematurely terminated, shall certify that it has <br />fulfilled the criteria for completion set forth in paragraph 14. <br />8. State Oversight and Obligations. The Division shall at any time have the <br />right to inspect any work required of SGC under this Consent Decree and, upon request by <br />SGC, the Division shall request that DMG inspect any of the mitigation projects to determine <br />whether the reclamation work has been completed in accordance with the reclamation <br />standards of DMG and the Work Plans. SUBJECT TO APPROVAL BY DMG <br />a. Within thirty (30) days of receipt by the Division of certification by <br />SGC that it has completed a mitigation project or projects, the Division shall request that <br />DMG inspect the Work. Within thirty (30) days after DMG has inspected the Work, the <br />Division shall in writing either confirm that SGC has completed that mitigation project or <br />projects according to the approved Work Plans and the applicable rkeclamation Standards of <br />the Division of Minerals and Geology or provide to SGC a written statement of the reasons <br />why the DiV.ision b$lievOS : : has not done so. <br />b. Within sixty (60) days of a request by SGC, the Division will complete a <br />Permit Release Assessment pursuant to through Section VIII of this Consent <br />Decree. <br />
