Hickenlooper
Governor
Mike King
Executive Director
Loretta Pineda
Director
The Division of Reclamation, Mining and Safety (DRMS) has investigated the complaint stated in your letter
dated June 4, 2012, but not received by the DRMS until June 15, 2012. The subject letter referenced
discussions with a local engineer and the local Division of Water Resources in Pueblo indicating that the
dewatering operations at the Evans #2 pit appear to be the cause of the low water table from which your
pumps draw water. Indications are that this problem began relatively recently. Based on the map you
emailed to DRMS and subsequent telephone conversations, the DRMS obtained the following information on
the wells in question from the Colorado Division of Water Resources website:
All of the above wells listed irrigation as the permitted use. The only well with a geologic log was 53051 -F.
The log indicated shale was encountered from 31 to 36 feet below ground and that the well is completed in
the shale.
The DRMS interviewed representatives of the Evans #2 Pit (Mr. John P. Ary and Denise Gonzales) about
current pit operations. The DRMS did not perform a site inspection as the site was inspected recently on
February 1, 2012. Mr. Ary indicated their dewatering operations have not changed since the inspection, nor
since Fremont Paving & RediMix, Inc. began operating the site in 2006, except they are not currently
washing the aggregate and are therefore using less water.
The DRMS reviewed the Evans #2 pit mine plan. Core drill reports referenced in the mine plan indicate there
is 8 to 12 feet of overburden and the aggregate depth ranges consistently from 20 to 25 feet thick.
