BEAR COAL COMPANY <br />SEDIMENT POND CERTIFICATION <br /> <br /> <br />In accordance with Rule 4.05.6(10), each sediment pond will be <br />inspected during construction under the supervision of, and <br />certified after construction by, a qualified registered <br />professional engineer. This certification is for the <br />reconstruction of the sediment pond located at the Bear No. 3 Mine. <br />The reconstruction of the pond was supervised by L. K. Jewkes, an <br />EIT and Colorado School of Mines graduate, who works under my <br />supervision. Mr. Jewkes has a wide variety of experience in the <br />construction industry. <br />The sediment pond was reconstructed in accordance with the approved <br />plan during the week of August 27, 1993. Sediment pond operations <br />are discussed in Exhibit 11, pages 11-12 and 11-13. The design of <br />the sediment pond is shown on Drawing 11-3, revised 7-28-93.
