DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Response to Reclamation Permit Partial Acreage Release Request Consideration
DATE: June 25, 2012
TO: —ric C. Scott, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: Sarah Brucker, P.E.
RE: Boettcher Limestone Quarry, File No. M- 1977 -348
Operator: Holcim (US) Inc.
Contact: (719) 784 -1402
Sec. 31, Twp. 9 North, Rng. 69 West, 6th P.M., Larimer County
COMMENTS: The applicant has requested a partial acreage release for the Boettcher Limestone Quarry. The
release is for approximately 536 acres, consisting of an 80.4 acre area in the southern portion of the property
and a 446.7 acre parcel to the north. This request is a modification of a previous request, dated April 3, 2012, to
exclude the land area associated with Pit 2.
A field inspection by DRMS staff on June 19, 2009 found that water has collected in the bottoms of several of
the reclaimed quarry areas. It is unclear whether or not these areas are included within the 536 acres that are
the subject of this partial acreage release request.
The Minerals Program Report also required Holcim to contact the State Engineer's office to determine what
options are available to deal with the water retained in the quarry areas, and provide DRMS with the appropriate
documentation of the resolution of this issue before the site can be released. This office has no record of any
contact from Holcim regarding the Boettcher Limestone Quarry.
Therefore, this office objects to the request for partial acreage release for the Boettcher Limestone Quarry.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
/ff0 3
John W.
