F <br />May 24, 2012 <br />Exhibit S <br />Las Animas County <br />200 East First Street <br />Trinidad , CO 81082 <br />Attn: Phil Dorenkamp, Road & Bridge Supervisor <br />RE: Engineering Evaluation for the Feister Gravel Pit Application <br />Dear Mr. Dorenkamp: <br />JUST Architectural & Engineering, Inc. <br />924 Smith Ave <br />Trinidad, CO 81082 <br />719- 845 -1566 <br />719- 845 -0887 (Fax) <br />This engineering evaluation is in reference to the above- gravel pit of which Las Animas County <br />is the applicant. Existing re- vegetated stock piles currently exist within approximately 75 feet of <br />the north fence line and 150 feet of the east fence line. (See attached Exhibit A.) Per the Mineral <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials the mining operations need to stay two hundred (200) feet away from <br />permanent man -made structures. Since the stock pile encroaches into this 200 -foot envelope of <br />the fence lines, Las Animas County has attempted to contact the adjacent property owners to <br />obtain a notarized agreement per 6.3.12 EXHIBIT L — Permanent Man -Made Structures <br />subsection (a). To no avail, the County was not able to obtain a notarized agreement. Per <br />subsection (b) the County has opted to procure an Engineering Evaluation as prepared by JUST <br />Architectural & Engineering, Inc (JUST A&E). <br />The fence locations surrounding this pit are approximately 75 feet from the proposed pit <br />boundary to the north and approximately 150 feet from the proposed pit boundary to the east. In <br />accordance with the Division's rules and regulations, the permit holder cannot conduct any <br />mining activities outside of this boundary. Therefore, it's JUST A &E's professional opinion that <br />the mining activities do not pose any potential harm to the existing fences as long as the permit <br />holder adheres to the Division's Rules and Regulations. <br />If you have any questions, please do not hesitate to call me. <br />Sincerely, <br />JUST Architectural & Engineering, Inc. <br />Robert D.
