Olson Pit Letter <br />Page 2 <br />Upon our reading of the agreement and upon our understanding that the current <br />agreement has been continually complied with, it is our opinion that your proposal can be <br />accomplished if the following items are addressed: <br />• That the agreement is modified by the inclusion of an updated Exhibit A <br />referencing the new Olson Pit configuration, specifically the elimination of Olson <br />Pit No. 1, the increase of Olson Pit No. 2 and the maintenance of Olson Pit No. 3. <br />• That the agreement is modified to clearly indicate that no more than the <br />originally agreed to 22.2 acres of exposed ground water and 44.4 acre -feet of <br />depletions will not be exceeded. <br />• That the DMG permit is modified to reflect the new configuration. <br />• That well permit no. 31249 -F relating to Olson Pit No. 1 is abandoned pursuant <br />to the reclamation activities. <br />• That a new well permit is sought for increase in Olson Pit No. 2. Please be <br />advised that the provisions of Colorado Revised Statute 37- 90- 137(2) prohibits <br />the issuance of a permit for a well to be located within 600 feet of any existing <br />well, unless the State Engineer finds that circumstances so warrant after a hearing <br />held in accordance with the procedural rules in 2CCR402 -5. This hearing may <br />be waived if you are able to obtain statements from the owners of all wells within <br />600 feet, verifying that they have no objection to your use of the proposed well. <br />If a new well permit is denied for reasons of 600 foot spacing, or any other <br />legitimate reason, our opinion on whether this proposal can be accomplished will <br />need to be re- evaluated. <br />We hope that this letter addresses your concerns and provides you the guidance you were <br />seeking.
