Mr. Kathryn Cloutier <br />Stagecoach SWSP <br />June 5, 2012 <br />Page 3 <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with § 37 -90- 137(11), <br />C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of June 1, 2012 through October 31, 2012, unless <br />otherwise revoked, modified, or superseded by decree. If this plan will not be made absolute <br />by a water court action by the plan's expiration date, a renewal request must be submitted to <br />this office with the statutory fee (currently $257) no later than September 15, 2012. <br />2. Well permit 63901 -F was issued for Stagecoach Pit on February 14, 2006 in accordance with <br />§ 37 -90- 167(2) and (11), C.R.S., and remains valid. <br />3. The total surface area of the ground water exposed at the Site must not exceed 0.05 acres <br />during the approval period of this SWSP resulting in an annual evaporative loss of 0.15 acre - <br />feet. <br />4. The total amount of water used for mining operations at the Site during 2012 must not exceed <br />1.0 acre -foot for dust control and the total product mined during 2012 shall not exceed 437,100 <br />tons of aggregate resulting in 12.86 acre -feet of water lost with the product. <br />5. Total consumption at the Site must not exceed the aforementioned amount unless an <br />amendment is made to this plan. <br />6. Once the slurry wall is approved by the State Engineer's Office as meeting the design or <br />performance leakage rate, native ground water trapped within the slurry wall may be removed <br />from within the lined area and returned to the stream system through surface flow or ground <br />water recharge without need for replacement, so long as the operator does not put the water <br />to beneficial use. The operator must provide replacement for all native ground water <br />remaining within the lined area that is put to beneficial use except for water removed in <br />product. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this water <br />must first be approved by this office. <br />8. All releases of replacement water must be sufficient to cover all out -of- priority depletions in <br />time, place, and amount and must be made under the direction and /or the approval of the <br />water commissioner. <br />9. The replacement water that is the subject of this plan cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to this site until a plan for augmentation is obtained. <br />10. All diversions shall be measured in a manner acceptable to the division engineer. The <br />Applicant shall install and maintain such measuring devices as required by the division <br />engineer for operation of this SWSP. For the purposes of this SWSP, the division engineer <br />requires a totalizing flow meter (TFM) to be installed to measure all diversions of ground water <br />including dewatering operations. <br />11. Adequate accounting of depletions and replacements must be provided to the division <br />engineer in Greeley (Div1Accountinq,state.co.us) and the water commissioner (William <br />Schneider, William .Schneider(a�state.co.us) on a monthly basis. All amounts shall be in acre - <br />feet. All submitted accounting shall conform to the Administration Protocol "Augmentation <br />Plan Accounting, Division One — South Platte River" (attached.) <br />
