John W. Hickenlooper, Governor
Christopher E. This letter also notifies the
permittee of the monitoring requirements associated with the stormwater discharge permit for this facility. The Division refers permittees
to EPA's website for a guidance document for stormwater monitoring and sampling (EPA 832 -B -09 -003, Industrial Stormwater Monitoring
and Sampling Guide, March 2009). Please review these materials closely.
Discharge Specific Information
Stormwater from the facility discharges to Sand Creek, within Segment 13c of the Cache La Poudre River Sub - basin, South Platte River
Basin, found in the Classifications and Numeric Standards for the River Basin (Regulation No. 38, effective 1/1/12). Segment 13c is
Reviewable and classified for the following beneficial uses: Aquatic Life (Class 2 Cold); Recreation (Class E); Water Supply; and Agriculture.
Basis for Stormwater Discharge Monitoring
The Division has determined that the practice -based effluent limits (i.e., SWMP and BMP requirements) in the stormwater discharge
permit are adequate to protect all water quality standards and meet any TMDL requirements applicable to stormwater discharges from
this facility.
However, as allowed by the stormwater discharge permit, the Division requires that the permittee sample stormwater discharges from
the industrial activities conducted at the facility to: 1) measure the effectiveness of the BMPs implemented at the facility with respect to
removing pollutants from the discharge or meeting any applicable TMDL requirements and, 2) establish whether additional BMPs are
required for any other pollutants for which the receiving water is impaired. The enclosed permit certification provides the sampling
parameters for stormwater discharges from the facility.
If information becomes available that indicates the stormwater discharge permit does not protect all water quality standards or meet
applicable TMDL requirements, the Division may require an individual or alternate general permit coverage. The Division will use results
from the stormwater discharge monitoring as part of this determination. Refer to the next section below for additional information.
Benchmark Monitoring
The enclosed permit certification also requires benchmark monitoring of stormwater discharges from the facility to confirm that
protection of water quality is provided. The specific parameters and benchmark values applicable to such discharges are taken from the
EPA 2008 Multi Sector General Permit (2008 MSGP) for Sector J – Non - Metallic Mineral Mining and Dressing.
Benchmark values for TSS are not hardness dependent, and were taken directly from the 2008 MSGP.
