Box 1298 <br /> Glenwood Springs,CO 81602 <br /> Re: Whole Effluent Toxicity("WET")at Outfall 016 and the Rook Tunnel Ponds Reclamation Plan <br /> - - CDPS Permit No. -0000396 Isitkin-Count3' - - <br /> Dear Ms.Delaney: <br /> A couple of issues have prompted this letter:the Aquatic Impairment Study C'AIS')results and the Colorado <br /> Division of Minerals and Geology's("DMG")desire to proceed with the reclamation plan for the Lack Tunnel <br /> Ponds. The AIS indicates thatt the discharge from Outfall 016 does impact the aquatic life of Dutch Creek. <br /> However, 1991 WET testing of the mine water entering the Rock Tunnel Ponds shows no WET to the species <br /> tested,while tht effluent discharging from the ponds showed toxicity to ceriodaphnia dubia. If the mine water <br /> influent to the pounds still demonstrates no WET,DMG intends to divert it from entering the ponds,routing it <br /> directly from the portal to the creek. The ponds'would continue to serve as storm water sedimentation ponds,if they <br /> are not a source of WET_ <br /> Discontinuing treatment of the mine water concerns the WQCD because of past Total Suspended Solids violations <br /> and the AIS's implication that increased silt and sand loading to the creek is adversely impacting <br /> maeroinvertebrates. Therefore,prior to DMG proceeding_we request that Mid-Continent Resources run acute WET <br /> tests using ceriodaphnia dubia and simultaneous Total Suspended Solids analyses,swVling the influent to the <br /> Rock Tunnel Ponds,and sampling the efficient discharging out of these ponds through Outfall 016,on two separate <br /> occasions between now and the end of June. We would like the data by July,if possible,so-DMG can complete their <br /> work during this construction season. <br /> Please let me know if you will be able to fulfill our request.
