COL ORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT, Water Quality Control Division <br /> Amendment No. I - Rationale. Page 2, Permit No. CO-0000396 <br /> Ill. PURPOSE OF AMENDMENT <br /> The oil and grease .section, Part 1.B.1.(c), is being modified to state that any time an oil sheers and/or floating oil is <br /> observed in a discharge, a sample shall be collected and corrective action shall occur. This is irrespective of case-by-case <br /> Dnvrston requested samples. <br /> %are Division will retain the right under this permit amendment to require the permittee to perform monitoring on a case-by- <br /> case basic. !'such monitoring is requested, we will submit a specific request to the permittee, then they would perform the <br /> monitoring as requested. The monitoring results shall be submitted to the Division immediatEiy upon receipt from the <br /> laboratory or other analytical source. if affluent limitation exceedences are indicated by the results, the permittee may be <br /> subject to enforcement action. The Division retains the right to reopen the permit to reinstate routine effluent monitoring if <br /> the permittee fails to maintain treatment systems or for any other reason where we find or suspect that compliance is not <br /> occurring. <br /> /V. AFFECTED SECTIONS OF THE PERMIT <br /> Parts I.B.1. and I.B.3. of the permit are (if <br /> fecved by this action. Pages v -x of the permit are amended. <br /> Jon C. Kubic <br /> November 8, 1995 <br /> V. PUBLIC NOTICE COMMENTS <br /> No written comments were received during the public comment period. A concerned citizen living in the vicinity of the mine <br /> sue was contacted by the Division about this amendment. He expressed verbal comments of a more general nature. His <br /> comments centered on his position that the Division or another independent authority not related to the permittee should be <br /> monitoring the discharges and the receiving stream, Coal Creek, on a routine basis. I indicated that the Division does not <br /> have sufficienr budget for this monitoring and therefore cannot perform this monitoring. The NPDES nationwide and CDPS <br /> Colorado discharge permit programs are based on trust. There are several checks in the system that would tend to indicate <br /> if monitoring results were not entirely accurate for any reason. <br /> The citizen indicated that he would submit his comments in written font. However, stone have been received after <br /> approximately 30 clays. Since no comments have been received in a timely manner and the expected comments are not <br /> directly related to this amendment, the Division is proceeding to issue the amendment unchanged. If the citizen submits his <br /> comments, the Division will respond to them appropriately at that time. <br /> Jon C. Kubic <br /> January 31, 1996 <br />
