be performed at the direction of the permittee, without any <br /> relief to the permittee of the statutory and regulatory <br /> obligations imposed upon it. <br /> The Division, through the Office of the Attorney General, has <br /> monitored the flow of cash collateral to Pitkin Iron through <br /> bankruptcy court. The cash collateral has been used exclusively <br /> to pay the expenses incurred by Pitkin Iron in performing <br /> reclamation of the site. There is no appearance that the agents, <br /> owners or controllers of Resources or Pitkin Iron have profited <br /> from Pitkin Irons' performance of reclamation. The Division <br /> continually monitors the reclamation work at the site by <br /> conducting frequent inspections during the construction season. <br /> The Division believes that the employment of Pitkin Iron by Mid- <br /> Continent Resources to accomplish reclamation of the mine site is <br /> supported by State and Federal statute and regulation, as well as <br /> the Mined Land Reclamation Board May, 1991; January, 1992 and <br /> May, 1992 Orders. Therefore, the Division of Minerals and <br /> Geology has appropriately implemented the approved program. <br /> -17- <br />
