Use of Sister Corporation to Perform Reclamation <br /> Your letter notes that Colorado allowed Mid-Continent Resources to use a sister <br /> corporation, Pitkin Iron, to perform reclamation work on the site after Mid-Continent <br /> declared bankruptcy. The nature of your objection to this arrangement is unclear. <br /> Since, by order dated January 23, 1992, Colorado had revoked Mid-Continent's right <br /> to mine, I find no fault with the State's action. In cases where either the permit or the <br /> right to mine has been revoked, both Federal and State regulations require the <br /> permittee to complete reclamation of the site even though that person may be <br /> ineligible to receive a new permit. Furthermore, neither the State nor the Federal <br /> regulations require that an individual possess a permit to conduct reclamation. <br /> Therefore, nothing in section 510 of SMCRA or the Federal or State regulations <br /> relating to ownership and control would prohibit the use of a sister corporation to <br /> perform reclamation activities. <br /> 4 <br />
