Nelson 6� <br /> Date: September 13, 1994 SEP 19 1994 <br /> Subject: Responsible Party at Mining-Sites Where DMG hl§'Rtvoked-the(Bondy <br /> The Water Quality Control Division has had somc questions on what to do with <br /> CDPS permits at mining sites where the Division of Minerals and Geology has <br /> revoked the bond. We have had mining companies ask for inactivation because of <br /> the DMG taking over the reclamation of the site. It is my understanding that per <br /> your rules and/or policy, the mining company or land owner are still responsible for <br /> all environmental permits. In other words, DMG has not assumed the liability for <br /> compliance with regulations other than its own. This implies that the mining <br /> company and/or the property owners are still the responsible parties for the CDPS <br /> permit. <br /> The Water Quality Control Division will proceed to hold the company responsible <br /> until the site has been suitable reclaimed. The Division would appreciate receiving <br /> from DMG notification when the bond has been revoked. This will enable us to <br /> remind those facilities that they need to maintain their CDPS permit.
