Box 309 <br /> 620 Main Street <br /> Carbondale, CO 81623 <br /> RE: Mid-Continent Resources land exchange <br /> Dear Kevin: <br /> As a follow-up to our meetings concerning a possible land <br /> exchange between the Forest Service and Mid-Continent Resources, <br /> I wanted to discuss the interplay between any land exchange, the <br /> liquidation plan, and the reclamation requirements pertaining to <br /> the mine site . <br /> Initially, it should be noted that, as Steve Renner told you <br /> at the meeting, the Division of Minerals and Geology is not <br /> opposed to the idea of a land exchange. Such an exchange would <br /> bring money into the bankruptcy estate of Resources and <br /> ultimately give the Division money for reclamation of the site . <br /> The Division is dedicated to its goal of ensuring that this site <br /> be fully reclaimed up to all applicable standards subject to the <br /> availability of funds . <br /> Under the liquidation plan which governs Resources' <br /> property, a Creditor' s Trustee (Louis LaGiglia) has the authority <br /> to sell property within Resources' estate. This authority <br /> applies to the mine site . For sale of a single item over <br /> $100 , 000, such as here, the trustee must have the approval of two <br /> Creditors' Representatives . <br /> If a sale of property occurs prior to completion of <br /> reclamation, the liquidation plan contains two relevant <br /> provisions : <br />
