The complainant has not requested <br /> confidentiality.The complaint alleges"..the failure of the State of Colorado to ensure complete <br /> reclamation of Mid-Continent Resources' mined lands in Coal Basin." <br /> Based on the complaint and supporting documentation provided OSM has reason to believe that <br /> bond forfeiture monies secured by DMG will not be sufficient to pay for the full cost of <br /> reclamation at the Coal Basin Mine. <br /> Therefore OSM issues this date Ton-Day Notice 98-140-116-001 which alleges non-;compliance <br /> with Colorado Rule 3 at 3.04.2(6) which states in part"The Division may complete necessary <br /> reclamation to the extent the forfeited funds permit and recover from the permittee, by means of <br /> civil proceedings and remedies all reclamation costs in excess of the forfeited amount to <br /> complete the remaining reclamation." OSM contacted Mid--Continent resources this date via <br /> telephone at(970)945-4958 and left a voice message requesting confirmation of Mid- <br /> Continent's current mailing address. <br /> Please address any questions concerning these actions to Henry Austin at 303-844-1466 or <br /> James Fulton at 303- 844-1424. <br />
