Box 309 <br /> Carbondale, CO $1623 <br /> Mr. Adam Poe <br /> Western Land Group <br /> 507 south Sherman Street <br /> Denver, CO 80209 <br /> Bear Kevin and Adam: <br /> Reference is made to Adam' s Memorandum dated March 14 , <br /> 1998 concerning proposal to acquire the remainder of the <br /> Preparation Plant tract on an exchange with Baas Pro Shops and <br /> suggesting that closing might occur in late October of 1998 . <br /> Tn my letter dated March 3 , 1998 directed to Kevin and <br /> to Steve Coupal, I attempted to outline concerns we have with <br /> respect to committing this property to contract in advance of <br /> resolving environmental issues, primarily relating to <br /> reclamation. <br /> Attached is copy of a "ten-day letter" from OSM to DMG <br /> based upon a Citizen' s Complaint (which OSM has declined to <br /> provide us with, although mentioned as an enclosure in the <br /> letter) directed to forcing DMG to institute further proceedings <br /> against Mid-Continent in an attempt to collect monies in excess <br /> of the $3, 000, 000 provided for in the approved Reclamation Plan <br /> and affirmed by the Bankruptcy Court , We can only construe this <br /> as an attempt to repudiate the Reclamation Plan, which was <br /> approved by OSM, DMG, Forest Service, BLM, et . al . , and embark on <br /> a much more expensive reclamation program. <br />
