In this fax, you requested that a <br />Federal inspection be conducted by OSM on your property. You stated than an area of your property has <br />been brought to final grade, but the final elevation is fifteen feet lower than the premining conditions. We <br />understand that the mining and reclamation operation on your property is the New Horizon Mine, <br />operated by Western Fuels- Colorado (WFC), under Colorado Department of Reclamation Mining and <br />Safety (DRMS) permit number C- 1981 -008. <br />We have contacted Mr. David Berry of the DRMS. As a result of your March citizen complaint and the <br />subsequent complete inspection, DRMS has requested that WFC collect elevation data from your property <br />and the adjacent WFC property to evaluate compliance with the approved Post - Mining Topography <br />(PMT). The data are to be presented to DRMS as point elevations on a map. The map will include a table <br />that describes the sample location as well as the anticipated thicknesses of surface spoil/subsoil/topsoil <br />that have not been placed. This evaluation will conclude what areas meet or do not meet the approved <br />PMT. <br />Since the matter of post - mining topography is already under evaluation by WFC and DRMS, and there is <br />no allegation of imminent harm, a Federal inspection will not be conducted at this time.
