Both stipulations have been satisfied by <br /> Mid-Continent. <br /> The Division has responded to Mr. Glen Tiedt' s comments in the findings <br /> document. First, the retention of the concrete lined channel is being <br /> approved by the Division as necessary to control erosion as allowed by <br /> State Rule 4.05.4(2) (a) and Federal Rule 817.44(b) (1 ) . <br /> Second, the worst case secnario for the effects of mine discharge is <br /> based on average flow conditions. This is the worst case condition. <br /> During low flow periods, the baseline total dissolved solids (TDS) <br /> content of Coal Creek is higher than during average flow conditions. <br /> This is characteristic of any stream because the base flow component has <br /> a higher TDS content than surface runoff. <br /> Third, the Division made an attempt to quantify the amount of sediment <br /> contributed by the road system. Because of the complex hydrologic system <br /> found in Coal Basin, standard stream monitoring will not give an accurate <br /> estimate of the sediment yields. Mid-Continent is currently sampling <br /> runoff water at the exit points from culverts to determine the sediment <br /> yields from the roads. In addition, Mid-Continent is currently and has <br /> in the past employed standard sediment control techniques on the road <br /> system such as gravelling the surface, maintaining ditches and culverts, <br /> etc. The Division eliminated the attempt to quantify sediment from the <br /> roads because that approach was felt to be inappropriate. <br /> 423 Centennial Ruildinq, 11113 Sherman Street Denver, Colorado 89203 TPI (303) 866-3567 <br />
