-52- <br /> stipulated the installation of ground water monitoring wells in and <br /> adjoining the refuse pile. The application has been amended, in response <br /> to Division requests in the Preliminary Adequacy Review, to include <br /> monitoring results collected to date and to state the company' s intent to <br /> conform with the original stipulations. The rock tunnel refuse pile is, <br /> therefore, in compliance with satisfactory resolution of the stipulation. <br /> The temporary fill over the large Dutch Creek culvert at the rock tunnel <br /> will be removed and the material will be placed on the cut of the tunnel <br /> face-up. This area will be graded to approximate original contour, then <br /> topsoiled to a depth of 12 to 16 inches. <br /> The applicant submitted no information on backfilling ana grading of the <br /> preparations plant area. This is evidently due to the proposed ski area <br /> post-mining land use (see Section II. of this document) , which calls for <br /> retention of much of the surface facilities area at the preparations <br /> plant. However, since the applicant cannot presently meet the <br /> requirements for a post-mining land use change, a backfilling and grading <br /> plan for the facilities area is necessary. Since no further disturbance <br /> of the facilities area is planned and reclamation will not occur until <br /> cessation of mining, this topic is amenable to stipulation. The Division <br /> finds that the following stipulation is necessary to make a finding of <br /> compliance with the backfilling and grading requirements: <br /> Stipulation No. 8 <br /> THE PERMITTEE SHALL SUBMIT A BACKFILLING AND GRADING PLAN, <br /> INCLUDING CROSS-SECTIONS ANU MAPS OF THE PROPOSED POST-MINING <br /> CONTOURS, FOR THE PREPARATIONS PLANT AREA TO THE DIVISION FOR <br /> APPROVAL BY DECEMBER 31, 1983. THE PERMIT APPLICATION MUST <br /> SUBSEQUENTLY BE UPDATED TO INCLUDE THE APPROVED BACKFILLING AND <br /> GRADING PLAN. <br /> The application has been amended, in response to the Division' s <br /> Preliminary Adequacy Review, to include a request for variance from <br /> approximate original contour reconstruction based upon steep slope mining <br /> conditions. For a discussion of this item, see Section XXIV, "Special <br /> Categories of Mining". The application also includes a request to defer <br /> final road reclamation design until the completion of further <br /> observations. For a discussion of this topic, see Section XX, "Roads". <br /> With satisfactory resolution of the stipulations, the proposed operation <br /> will be in compliance with the requirements of this section. <br /> XVII. ;dine Facilities, Coal handling Structures, Support Facilities <br /> - Mules 2.05.3(3) , 2.0 5.3( ) and 4.04 <br /> The mine facilities, coal handling structures, and support facilities in <br /> Section II-3 of Volume 1 of the application have peen reviewed for <br /> compliance by the Division. <br />
