-2- <br /> PROPOSED DECISION <br /> Coal Basin Mines <br /> The Colorado Mined Land Reclamation Division proposes to approve, with <br /> stipulations, an application for a permit to conduct coal mining <br /> submitted by the Mid-Continent Resources, for the Coal Basin Mines. <br /> This approval decision is based on a finding that the proposed operation <br /> will comply with all requirements of the Colorado Surface Coal Mining <br /> Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seq. , and the <br /> regulations promulgated pursuant to the Act. <br /> The permit application and the stipulations will become a binding part of <br /> the permit upon approval . The stipulations for the Coal Basin Mines are <br /> as follows: <br /> C= r <br /> Stipulation No. 1 eel �f <br /> PR <br /> IOR TO ANY DISTURBANCE AT THE SITE OF THE PROPOSED NEW COAL �V'' <br /> PROCESSING WASTE EMBANKMENT, THE PERMITTEE MUST SUBMIT EVIDENCE TO <br /> THE DIVISION THAT LEGAL RIGHT OF ENTRY HAS BEEN OBTAINED FROM THE <br /> U.S. FOREST SERVICE. <br /> Stipulation NO. 2 <br /> PRIOR TO REACTIVATION OF MINE NUMBER 4, THE PERMITTEE MUST <br /> CONSTRUCT THE SEDIMENT PONDS, AS DESIGNED, ON THE SOUTHEAST SIDE OF <br /> THE MINE NO. 4 BENCH. <br /> Stipulation No. 3 co <br /> S <br /> WITHIN 30 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST REVISE THE <br /> SEDIMENT CONTROL PLANS FOR THE THREE PROPOSED SEDIMENT PONDS AT THE <br /> SITE OF THE NEW COAL PROCESSING WASTE EMBANKMENT. THE PLANS MUST <br /> BE REVISED TO INCLUDE A NON-CLOGGING, GATED DEWATERING DEVICE <br /> LOCATED DIRECTLY ABOVE THE MAXIMUM STORAGE LEVEL OF EACH POND. <br /> Stipulation No. 4 <br /> WITHIN SIX MONTHS OF PERMIT•ISSUANCE, THE PERMITTEE SHALL SUBMIT TO <br /> THE DIVISION CERTIFICATION FROM A REGISTERED PROFESSIONAL ENGINEER, <br /> ATTESTING THAT THE SEDIMENT PONDS PRESENTLY CONSTRUCTED HAVE BEEN <br /> BUILT AS DESIGNED. CERTIFICATION OF THOSE PONDS YET TO BE <br /> CONSTRUCTED MUST BE SUBMITTED IMMEDIAT-4Y FOLLOWING CONSTRUCTION. <br />
