IV. Problems, Recommendations and Compliance Dates The operator is advised that the following problems have been identified during inspections and that failure to correct the problems may result in the Division taking an ENFCRCE,IENT ACTION pursuant to CRS 1973, as amended, 34-33-123. (Recommendations and compliance dates are to be clearly noted. Dates are to be specific, e.g. , January 31, 1982 and underlined.) 017-82-37 The road drainage ditch on the tipper part of the Mine No. 3 road must be regraded by October 18, 1982. 017-82-38 Clean the first culvert above the lower Mine No. 3 bin by October 11, 1982. 017-82-39 Clean the culvert located at 150+50 on the Mine No. 5 road by October 11, 1982. 017-82-40 Clean the third culvert above the intersection of the Mine No. 5 road by October 18, 1982. 017-82-41 The drainage ditch below the culvert at the entrance to Mine No. 4 road must be repaired by October 11, 1982. 017-82-42 The berm along Coal Creek southeast of the MK shop must be rebuilt by October 18, 1982. 017-82-43 The drainage ditch below the Mine No. 1 coal stockpile and behind the wash plant must be cleaned by October 18, 1982. 017-82-44 The berm along the Mine No. 3 lower bin pad must be repaired by October 11, 1982. 017-82-25 In the previous inspection report, it was noted that coal was cleaned from the outslope of the berm around the Mine No. 2 stockpile. This has not been accomplished. A compliance date of October 1, 1982 was placed on this problem. However, until the Mine No. 2 stockpile is removed, clean-up will result in more environmental damage than leaving the coal in its present location. The operator has put up straw bales to control any runoff from this area. Therefore, the operator must clean-up the coal below the berm when coal is removed sufficiently to allow removal. 017-82-29 Clean sediment from the preparation plant slurry pond by October 1, 1982.
