II. Compliance :pith Colorado Surrace Coal Minir_g Reclamation .act
CRS 1973, as amended 34-33-101, et. seq. ,
and the
Rules and Regulations issued Pursuant `o e qct
This includes a listing of the particular provisions of t e regulatory program rr:ich :sere
examined during t^e course of this inspection, and identifies enforcement actions taken
during the inspection for failure to comply Frit
the permit. h g Act Rules and Regulations, the ct and
4.02 Signs and Markers
The mine identification signs were in compliance. All topsoil markers were in
place.
4.03 Raods
The culverts along the road to mine #5 have not been repaired. Mr. Bowman explained
that snow had made the work impractical to do. With the amount of snow present at
the time of this inspection, it was evident that the work could not be completed.
The bent culverts should function properly during spring snowmelt, but will have to
be repaired immediately following snowmelt.
4.05 Hydrologic Balance
1. Water-piping had occurred under the conveyor system, on the east side of the
Dutch Creek Flume. This area must be backfilled and compacted to assure that
disturbed drainage does not enter Dutch Creek.
2. The riser on the dewatering device of the lower refuse pile pond, adjacent
to the Dutch Creek Flume, had been broken off.
3. A Berm should be placed along Coal Creek, northwest of the thermal dryers to
assure that drainage from the yard does not enter Coal Creek.
