• <br />6.4.2 EXHIBIT B -Index Map <br />Please see the Comment in Item 1 above for the explanation. <br />6.4.3 EXHIBIT C- Pre - Mining & Mining Plan Maps <br />Please see the Comment in Item 1 above for the explanation. <br />Both Maps have been re- labeled to reflect a difference in Exhibits such as C.1, C.2 & <br />C3. <br />6.4.5 EXHIBIT E- Reclamation Plan <br />The following comments relate to Rule 3.1 as referenced from Rule 6.4.5(2)(c) <br />Orlando E. Martinez and Rose Marie Martinez privately own the land. <br />3.1.4 the Landowner name has been revised to show that the landowners are Orlando E. <br />Martinez and Rose Marie Martinez. Now reads as follows: <br />3.1.4 Public Use <br />The Operator /Applicant and Landowners do not propose the use of this land by the <br />public. Mining will be done by Huerfano County Public Works and/or an MSHA <br />approved contractor and the public will not be allowed on site without a Huerfano County <br />representative, Part 46 of MSHA will be followed on this site. After the site has been <br />released by the MINED LAND RECLAMATION BOARD (MLRB), the Landowner <br />Orlando E. Martinez and Rose Marie Martinez may allow public access if it is deemed <br />beneficial to the landowner. <br />3.1.10 Revegetation <br />3.10(4) has been revised as follows: <br />Since this mine site will reclaimed for cattle grazing, grazing will not begin until <br />the grasses have been established to a point that the landowners Orlando E. Martinez and <br />Rose Marie Martinez, in conjunction with the Division of Reclamation, Mining and <br />Safety, and the local Soil Conservation District/NRCS, determine it is ready for such use. <br />6.4.6 EXHIBIT F- Reclamation Plan Map <br />Please see the Comment in Item 1 above for the explanation. The Reclamation Plan Map <br />has been revised to the correct legal description and plan map in Exhibit F. <br />6.4.7 EXHIBIT G- Water Information <br />Paragraphs (3) & (4) now read as follows: <br />(3) There will be no water requirements for processing the product. All products produced will <br />be processed dry and no water is added. Mining and reclamation phases will not require water. <br />Water for dust control will be legally acquired by Huerfano County and trucked to the mine site <br />for use in the processing to mitigate fugitive dust from crushing, screening and conveying, in <br />addition watering the site and haul road to keep the dust under control. <br />
