Box 670 <br />Hayden CO 81639 <br />RE: Yoast Mine (Permit No. C 1994082) <br />Technical Revision No. 46 — Pond 012 Slide Remediation <br />Topsoiling and Seeding of Pond 012 Slide Area <br />Dear Mr. Karo: <br />Last year, the Division and Seneca Coal Company (SCC) agreed to postpone topsoil redistribution and <br />seeding of the Pond 012 slide area at the Yoast Mine until 2012. The delay was warranted to protect topsoil <br />resources in the event that the area was not yet stabilized. The past winter was extremely dry and was not <br />likely a good test of whether the remediation efforts in the Pond 012 slide area were successful. In order to <br />ensure that topsoil resources would not be lost should a subsequent slide occur, it would be best to verify the <br />stability of the area under normal conditions before topsoil is replaced. Therefore, the Division recommends <br />that SCC further delay topsoil replacement and seeding until 2013. Topsoil replacement and seeding must <br />be completed no later than December 31, 2013. In the interim, it is imperative that Seneca Coal Company <br />continue to control noxious weeds on the topsoil stockpile and regraded areas even though final reclamation <br />of the areas will be delayed. <br />The 2011 Rill and Gully Map submitted by SCC indicates that the Pond 012 area will be topsoiled, and that <br />the road leading to the topsoil and slide area will be reclaimed.
