Jim Herron <br /> Mined Land Reclamation Division <br /> 423 Centennial Bldg. <br /> 1313 Sherman St . <br /> Denver, Colorado 80203 <br /> Re : Coal Basin - Permit No. C-017-81 <br /> Variance from Stream Buffer Zone <br /> Dear Jim, <br /> It has come to my attention that we were supposed to <br /> have a channel change or diversion adjacent to the tunnel <br /> rock-fill area in order to maintain a 100' stream buffer <br /> zone. <br /> The channel through this area is quite deep--15 '+ to <br /> 20'+--and is well-defined, and appears to me to be quite <br /> detrimental to the environment to dig a new channel <br /> through existing vegetation, not to mention the dirt <br /> excavation, just to say "Look, now our road and rock pile <br /> are 100' from the stream.
