The Division, based upon its inspection experience within Coal Basin, agrees with the company' s request for variance in this regard. The subsidence monitoring aspects of Mid-Continent Resources, Inc. application for the Coal Basin felines are acceptable to the Division. During the course of the review, it was noted that if subsidence were to occur, lands outside the permit area could be affected, assuming a conservative angle of draw of 20.50. Mid-Continent satisfied this concern by agreeing to limit the extraction of coal to those areas defined by the projection of the lease perimeters to the depth of the coal seam being extracted, along an angle of draw of 20.50 from vertical . Alternatively, coal may be extracted to within 50 feet from the lease boundaries provided written consent and approval is obtained and filed with the Division from surface landowners of the area adjacent to the leases located within a 20. 50 angle of draw from vertical . The proposed operation is in compliance with the requirements of this section. XXIII. Special -Categories of Mining - Rules 4.27 and 4.23 The only special categories of mining that apply to the Coal Basin operation are coal processing plants and support facilities not located at or near the mine site and operations on steep slopes. Coal Processing Plants and Support Facilities Not Located at or Near the Mine Site Information on the Coal Basin loadout facility which was reviewed by the Division can be found in Chapter VII and Appendices of Volume 7 of the application. Plid-Continent Resources operates a coal loadout facility in Carbondale, Colorado, 22 miles from the mine site. The proposed permit area is 27 acres. The existing loadout facility is designed to handle two million A �� tons of coal per year. The coal loadout facility consists of a railroad �,Y,► spur, access roads, parking lot, engineering office, scales, covered 23,000 ton slot bin, conveyors, and train loadout tipple.
