Mr. Johnson presented EXHIBIT A -- signed copies of the Agreement
reached between the parties to approve the Technical Revision. He
explained that, through the terms of the Agreement, the Garfield
Citizens' Alliance withdrew its objection to the approval of the
Technical Revision, on the condition that the Board enter an Order
containing new stipulations to the Technical Revision that specify the
time for construction of the water treatment facility.
Mr. Frank Johnson asked that the Board grant the request for approval
of the Technical Revision and enter the Order (EXHIBIT B), which
conditions the approval of the Technical Revision on the schedule set
out in the Order.

Mr. Frank Johnson, Assistant Attorney General, informed the Board that
the operator had, today, provided a settlement offer that the Division
would like time to review. The operator has agreed to a continuance,
and the Division plans to present a proposal to the Board during the
March 1991 Board Meeting.
Mr. John Bachmann, council for the operator, said the operator would be
working on a settlement stipulation with the Division for presentation
at the March Board Meeting.
It was MOVED that the Board approve the petition to continue this
matter. SECONDED AND PASSED UNANIMOUSLY (Cooley, Jouflas, O'Connor,
Danielson, Entz and Cottony).
