Box 158 <br /> Carbondale, Colorado 81623 <br /> Re: Coal Basin Mines <br /> Our File No. C-017-81 <br /> Dear Mr. Bowman: <br /> As stated in our phone conversation of Thursday, May 24, 1982, the Division <br /> will not be issuing a Notice of Violation for failure to follow the <br /> approved mine plan concerning the disposal of trommel screen rock in the <br /> rock tunnel waste disposal area. However, the Division is very concerned <br /> over the failure of Mid-Continent to notify the Division of this change <br /> and receive Division approval prior to its inception. Mid-Continent must, <br /> in the future, notify the Division in the form of a minor revision or <br /> technical revision when any change in the mining and reclamation plan or <br /> change in facilities, etc. are necessary. This is particularly important <br /> for keeping the approved permit application current. <br /> There have been two other incidents in the past year which contribute to <br /> the Division's concern. These are the construction of an additional <br /> sediment pond near mines #1 and #2 and remodeling the preparations plant. <br /> Although these activities generally result in no significant environmental <br /> damage, the Division should have been notified of these changes, as <br /> required by the Act and Rules and Regulations. <br /> Future failure to follow the approved mine plan may result in enforcement <br /> action. <br /> If you have any questions concerning this matter, please call. <br /> S 'ncerely, <br /> Herron <br /> R clamation Specialist <br /> JH/mt <br />
