n. Estimated Reclamation Costs <br /> Both Mid-Continent's and Mined Land Reclamation- Division' s <br /> reclamation cost estimates are included in this section. The <br /> applicant' s estimate total is $972,940 while the Division' s is <br /> $1,970 ,148. The major differences in calculating reclamation <br /> costs between the applicant and the Division result from the <br /> Division's position that portal benches must be backfilled to <br /> approximate original contour, haul roads must be backfilled <br /> utilizing down-slope fill as the method of downgrading them to <br /> access roads, rock tunnel and coal processing waste piles must be <br /> covered with large amounts of topsoil, and the sediment control <br /> system must be completely reclaimed. <br /> Mid-Continent Resources does not agree with the Mined Land <br /> Reclamation Division's reclamation cost estimate calculations , <br /> nor with the assumptions on which they are based, but would <br /> expect that the Division would be reasonably flexible, and would <br /> be responsive to specific reclamation proposals to be submitted <br /> at the time, recognizing changes in circumstances and legal <br /> requirements. Accordingly, reclamation bonding will be accom- <br /> plished to support the Division' s estimates without prejudice to <br /> the applicant' s rights to seek relief from specific hardships <br /> that may be imposed, and does not constitute an acceptance or <br /> final determination of the specific reclamation steps that will <br /> be taken. <br /> Mid-Continent will initiate engineering stability studies <br /> that will produce actual figures determining the amount of mine <br /> bench and roadway backfilling that will be practical in accom- <br /> plishing reasonable reclamation of those areas.
