Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division has completed its review of the above referenced report received on April 2, 2012. The <br />Division finds the report to be in general compliance with Rule 2.04.13 and the permit. However, there <br />are several items that will need to be addressed as discussed below. <br />Annual Report Form: <br />1.) The permit number listed on the report form indicates the permit number is C -94 -081. The correct <br />permit number is C- 1992 -081. Please send a revised page with the correct permit number. <br />2.) On the ARR form submitted; under the " For Government Performance and Results Act it <br />indicates the acreage in long -term mining or reclamation facilities to be 83 acres. This area included the <br />total disturbed area (97.1 acres) minus the acres backfilled, graded, topsoiled and seeded (14.1 acres). <br />As of this time, none of these areas have been released from bond liability, so the area reported for this <br />section should be the total 97.1 acres. <br />2.04.13(1): <br />(a)- The narrative of the ARR included the name of the permittee, the address and the permit number. <br />(b)- No additional acres were disturbed during the calendar year 2011. <br />(c)- 12.7 acres were backfilled and graded during 2011. These areas included 11.9 acres in the former <br />loadout facilities area and .8 acres associated with Topsoil Pile TS -1. <br />(d)- 12.7 acres were topsoiled during 2011. These areas included 11.9 acres in the former loadout <br />facilities area and .8 acres associated with Topsoil Pile TS -1.
