QPPMENT AKE
United States Department of the Interior Wc" E
vi t 9
O
7
_ OFFICE OF SURFACE MINING m
gRCH 3 A
Reclamation and Enforcement
IN REPLY REFER TO
Suite 1200
505 Marquette Avenue N.W.
Albuquerque,New Mexico 87102
April 4, 1994
Mr. Michael B. Long, Director 4Ps .,
Division of Minerals and Geology 1
Department of Natural Resources C; .., ®;;,19
215 Centennial Building c-
1313 Sherman Street _
Denver, Colorado 80203
Re: Coal Basin Mine, Mid-Continent Resources
Dear Mr. Long:
The Office of Surface Mining Reclamation and Enforcement (OSM) has reviewed all of the
available documents regarding the variance for placing 4 feet of cover over coal waste
piles. The review was conducted to determine compliance with Federal regulation 30 CFR
816.83(c)(4) and Colorado regulation 4.10.4(5).
Based on the submitted material, it is OSM's opinion that the demonstration for the Sutey
Pile is adequate and meets the demonstration requirements of the Federal and the State
program. This pile should be reclaimed in accordance with the approved reclamation plan.
However, for the remaining two piles, the Old Coal Refuse Pile and the Rock Tunnel
Waste Pile, there is insufficient information to make a decision. Therefore, at this time,
Title V regulations as well as the approved State program require that 4 feet of material be
placed on the two piles.
It is OSM's opinion that if the chemical composition and the compaction of these two piles
are similar to that of the Sutey Pile, then the less than 4 feet of material requirement could
be waived. If this affirmative demonstration is made, then OSM believes, at a minimum,
these piles would have to be covered to a depth, using the same criteria, as the Sutey
Pile. In other words, it must be demonstrated that the two piles have similar
characteristics of the Sutey Pile in order to apply the variance to the two piles.
If you have any questions, please call me at (505)766-1486.
Sincerely,
Robert H. Hagen, Director
° Albuquerque Field Office
