The review was conducted to determine compliance with Federal regulation 30 CFR <br /> 816.83(c)(4) and Colorado regulation 4.10.4(5). <br /> Based on the submitted material, it is OSM's opinion that the demonstration for the Sutey <br /> Pile is adequate and meets the demonstration requirements of the Federal and the State <br /> program. This pile should be reclaimed in accordance with the approved reclamation plan. <br /> However, for the remaining two piles, the Old Coal Refuse Pile and the Rock Tunnel <br /> Waste Pile, there is insufficient information to make a decision. Therefore, at this time, <br /> Title V regulations as well as the approved State program require that 4 feet of material be <br /> placed on the two piles. <br /> It is OSM's opinion that if the chemical composition and the compaction of these two piles <br /> are similar to that of the Sutey Pile, then the less than 4 feet of material requirement could <br /> be waived. If this affirmative demonstration is made, then OSM believes, at a minimum, <br /> these piles would have to be covered to a depth, using the same criteria, as the Sutey <br /> Pile.
