be conducted at it's expense. Closing of the sale will occur in August, 1994. These <br /> proceeds will be deposited in the reclamation account. <br /> 1994 RECLAMATION Currently, salvage operations conducted by Machinery and <br /> Equipment Company, continue at the mine. Machinery and Equipment retains a portion <br /> of salvaged materials sales proceeds, while the remainder helps to fund reclamation. <br /> Building and equipment removal will be completed at the mine entries this year. <br /> Salvage and removal of debris, equipment and other materials at the Rock Tunnel Entry <br /> and at the facilities area will continue. The Division is completing an Invitation for <br /> Bid document which contemplates reclamation of the Sutey Refuse Pile and reseeding of <br /> the Number 5 Mine area. This work is anticipated to commence in late September. <br /> SITE VISITS The Division has hosted two unique site inspections this year. The <br /> relocation of Coal Creek as part of the reclamation process has been discussed for some <br /> time. In order to find a solution to the many technical difficulties posed by this task, the <br /> Division invited experts from the U.S. Geological Survey, U.S. Army Corps of Engineers, <br /> U.S. Forest Service, and the Office of Surface Mining to walk the channel and attempt to <br /> find solutions. It was a productive meeting which helped to narrow the scope of the <br /> problem and set a course for designing a functional post-reclamation channel. <br /> - The Division and the Office of Surface Mining jointly hosted a site inspection by <br /> members of the Crystal Valley Environmental Protection Association. This inspection <br /> was held in response to the CVEPA's request to access the site. Again, the visit was <br /> enlightening for the State and Federal regulators as well as for the CVEPA, as the scope <br /> of citizen concerns and site problems were well discussed. <br /> - The Director of the Office of Surface Mining, Bob Uram, visited Coal Basin <br /> during his tour of Colorado coal mining operations in mid-June. This visit was <br /> productive in that he was able to view the mine first hand, and walk away with a better <br /> sense of the reclamation tasks which must be accomplished. <br /> 1995 RECLAMATION PLANS Now that the reclamation account is finally being funded, <br /> reclamation contracts may be let. The Division plans to let contracts in 1995 which <br /> would accomplish reclamation of the mine site based upon greatest environmental need. <br /> Current thinking is that the highest priority sites (those with the greatest potential for <br /> environmental impact) are the sites located highest in the watersheds. Backfilling, <br /> grading and revegetation of the Numbers 1,2,3,4 Mine entries, benches and outslopes and <br /> associated roads will be slated for reclamation. Reclamation activities will proceed down <br /> hill on a priority basis thereafter. Reclamation is contemplated to be completed in late <br /> 1996, dependent upon the availability of funds. <br /> PERSONAL LIABILITY SUIT The Judge assigned to hear the case has excused himself <br /> from hearing the matter. A new judge will be assigned by the court system to hear this <br /> matter, probably outside Pitkin County District Court. <br /> 2 <br />
