The assertion that information is <br /> being withheld is particularly ludicrous given the fact that the <br /> Invitation to Bid document which Mid-Continent has in its <br /> possession describes how to obtain some of the information which <br /> Mr. Lewicki has requested. Page 2 of the Special Conditions states <br /> that Bid results may be obtained from the Division of Purchasing by <br /> sending them a stamped self addressed envelope. Information <br /> regarding the award of the Bid may also be obtained from the <br /> Division of Purchasing. In this particular case, the Bid was not <br /> awarded at all . Public records on file at the Division Office in <br /> Denver and at the Division of Purchasing will reveal that the our <br /> agency notified the Division of Purchasing of the Bid cancellation <br /> on October 7, 1994. Local newspapers have also reported the fact <br /> that the Bid was not awarded. <br /> The technical review for the drainages consisted of assimilating <br /> information from the Coal Basin permit document. Documents <br /> utilized include Map II-B-App5-4; cross sections C-C' , F-F' . Rip <br /> rap specifications were adopted from phone conversations between <br /> Jim Herron and myself. Topsoil application depths were derived <br /> from the Coal Basin permit document. Revegetation specifications <br /> were derived from the Coal Basin permit document, the Mid-Continent <br /> Request for Proposals developed by Mr. Lewicki in the Spring of <br /> 1994 and based upon field conversations between Mr. Lewicki and <br /> myself in June and July, 1994 . Sutey grading specifications were <br /> to be designed in the field during construction in order to assure <br /> that remaining foundations were buried or removed as necessary, and <br /> that remnant benches existing on the pile were eliminated. <br /> In order to avoid future confusion and conflict, it may be <br /> advisable for the Division staff to meet periodically with Mid- <br /> Continent staff to discuss the preparation of reclamation bid <br /> documents. These meetings could be held on a monthly basis. Also, <br /> the Division could place Mid-Continent and Mr. Lewicki on a mailing <br /> list so that they receive the Invitations to Bid. We could also <br /> make efforts to provide Mid-Continent with draft copies of the <br /> Invitations to Bid for their comment. <br /> As the requests which Mr. Lewicki has made are directly related to <br /> the reclamation construction and bidding process, I would suggest <br /> that Mr. Lewicki be directed to either myself or David Bucknam for <br /> further clarification of reclamation specifications, or to the <br /> Division of Purchasing for the Bid information. <br /> CC: David Bucknam <br /> Cheryl Linden <br /> C:\wp51\bill <br />
