2. If the Sanwa negotiations prove unfavorable, then the Division will obtain <br /> whatever funds possible from the forfeiture of the cash bond, and initiate <br /> reclamation proceedings for the highest priority items. The Attorney General's <br /> Office simultaneously will begin proceedings for obtaining the necessary <br /> additional funds through litigation. Should litigation prove unfavorable, the <br /> Division will revise the reclamation plan to the extent allowed by available <br /> funds; provide it to the CVEPA for comment, incorporating CVEPA concerns to <br /> the extent practicable; and present the plan and an update regarding the latest <br /> developments to the Board.
