ROBERT DELANEY TEL No . 303-945-2303 Mar . 61 , yJ 11 : 16 F . u5 <br /> 1 .4 "Sale Closing" means transfer of Mine Property to <br /> REDSTONE following Bankruptcy Court Order and delivery of transfer <br /> documents by the Escrow Holder. <br /> 1 . 5 "Bankruptcy Transfer Order" means an Order issued by <br /> the Bankruptcy Court in Case No. 92 11658 PAC, United States <br /> Bankruptcy Court, Denver, Colorado which Order approves the asset <br /> sale. <br /> 1. 6 "Approving Agencies" means Mined Land Reclamation <br /> Division (MLRD) and Mined Land Reclamation Board (MLRB), and also <br /> Office of Surface Miming. <br /> 1.7 "Reclamation Bond" means a Bond conforming to <br /> requirements of approving agencies for the reclamation of the mine <br /> property in accordance with the mine permit and with corporate <br /> surety or other surety meeting requirements of MLRD. <br /> 2.0 Successor Operator. <br /> 2. 1 REDSTONE requests approval as a Successor Operator <br /> and will provide any additional required documentation in support <br /> of this request to become a Successor Operator on Permit No. C-81- <br /> 017.
