As you pointed <br /> out, there are a number of options available to the Division <br /> concerning who accomplishes the reclamation work at the <br /> Coal Basin Mine. <br /> Currently, we continue to negotiate with Mid-Continent Resources in an <br /> attempt to have the company do the work under a plan approved by the <br /> bankruptcy court and the Mined Land Reclamation Board. The provisions <br /> of the Colorado Surface Coal Mining Reclamation Act requires that the <br /> permittee reclaim the site to the standards of the Act and the <br /> approved permit. The Division believes that it is important that the <br /> responsible party, in this case Mid-Continent, be required to perform <br /> the reclamation tasks. If, for whatever reasons, Mid-Continent does <br /> not perform the reclamation tasks at the site, the Division will <br /> pursue other options to achieve reclamation. As you described, a <br /> reclamation contractor could be retained to do the work in this <br /> scenario. <br /> If an independent contractor is used, it will be necessary to put the <br /> project out for competitive bid.
