( b) Dutch Creek is actively cutting into the bank that
supports part of a waste pile located southeast of the
preparation plant . (This bank is south of Dutch Creek ; we were
unable to determine if this pile was connected to the waste pile
described in (a) above . ) The bank is steep , almost vertical , and
very unstable . Rocks and dirt are eroding into the creek and
trees have been uprooted and fallen down the bank , which we
estimate to be at least 30 feet high . This material could
partially block the creek and cause more rapid erosion into the
waste pile on top .
OSM should immediately inspect the site and issue imminent
harm cessation orders and require immediate abatement of these
conditions . In accordance with Colorado Rule 5 . 02( 4) and 30 CFR
842 . 12( d) , we request that the results of any inspection be
reported to us within 10 days from the date of the inspection or ,
if no inspection is done , to explain to us in writing the reasons
for that decision within 15 days from the date that this letter
is received .
Please note that we have mailed a copy of this report to the
Colorado Division of Mining and Geology .
We waive our rights to confidentiality and request the right
to accompany the OSM inspector on the inspection of the mine
site .
