Delaney: <br /> This letter is a summary of the December 2, 1992 meeting between you and <br /> John Reeves , representing Mid-Continent Resources (MCR) , and Dan Hernandez and <br /> me , representing the Division. Discussed were a variety of proposed <br /> modifications to the approved reclamation plan for the Coal Basin Mine. <br /> Following are summaries of the items discussed at the meeting and/or contained <br /> in the MCR letter of November 30, 1992. This is followed by a response to <br /> requested changes to and/or clarifications of the items discussed. <br /> Portal Sealing <br /> The Division is in agreement with MCR regarding installation of free draining <br /> portal seals at the rock tunnel adits. As the Division understands MCR, any <br /> water generated in the mine will drain out of the rock tunnel adits. It <br /> should be noted that any water discharging from any underground opening will <br /> require sampling and, if necessary, treatment to meet receiving stream <br /> standards. This activity could and probably will be required well into the <br /> future. <br /> The MSHA plan you have submitted apparently calls for free draining seals at <br /> most portals. These portals would of course fall under the same compliance <br /> requirements as the rock tunnel . <br /> Construction of the various underground block walls , as previously approved, <br /> is obviously not possible at this time due to the mine being flooded, and <br /> therefore no longer required. <br /> Portal Benches <br /> The outlying portals (1-5) at the mine were all developed prior to passage of <br /> the Surface Mining Control and Reclamation Act of 1977 . Since these are <br /> pre-law disturbances , the requirement to return them to Approximate Original <br /> Contour (AOC) does not apply. As we understand the new MCR proposal , <br /> reclamation of the portal benches as currently approved in the permit will be <br /> followed . <br />
