Mid-Continent Resources, Inc. <br /> Carbondale, Colorado <br /> Plan for Sealing of the Dutch Creek, <br /> L.S. Wood, Bear Creek, and Coal Basin Mines <br /> 1 . 0 Sealing will proceed as expeditiously as weather and seasonal <br /> conditions, Bankruptcy Court approval , availability of funds <br /> from the bankruptcy estate; and authorization, if necessary, <br /> by the Colorado Mined Land Reclamation Division, all as <br /> outlined in Mid-Continent ' s letter of November 4, 1992, to the <br /> District Manager, MSHA District 9, Denver, Colorado, and <br /> incorporated herein by this reference, will permit. <br /> 2 . 0 Mid-Continent will petition the U.S. Bankruptcy Court for <br /> authorization to expend funds realized from the sale of assets <br /> from the bankrupt estate for sealing of the L. S. Wood (No. 3, <br /> MSHA ID No. 05-001000) , Coal Basin (No. 5, MSHA ID No. 05- <br /> 02342 ) , Dutch Creek Mime (No. 1, MSHA ID No. 05-00301 ) , and <br /> Bear Creek (No. 4 , MSHA ID No. 05-003510) . <br /> 3. 0 Upon approval of the U . S . Bankruptcy Court for authorization <br /> to expend funds and the availability of such funds, either via <br /> asset sales or advances from creditors , Mid-Continent, via its <br /> designated mine operator, A.M. King Industries, Inc. or via <br /> other qualified contractors, will proceed with sealing the <br /> portals of the mines stated section 2 .0. <br /> 4 .0 the sealing of mine portals shall continue on a normal weekly <br /> schedule, Monday through Friday, weather and seasonal <br /> conditions permitting. Due to safety concerns on steep, rocky <br /> slopes, narrow roads, and winter avalanche dangers, work will <br /> be suspended during inclement weather and winter months when <br /> the portals become inaccessible due to snow cover. <br /> 5.0 All mine openings, with the exception of those specifically <br /> identified below, will be sealed by filling the openings with <br /> 25 feet of incombustible ma(:erial in accordance with 30 C.F.R. <br /> S 75.1711 . 2, or by shooting with explosives the immediate mine <br /> roof for a distance of 25+ feet as described below or, by <br /> sealing the portal with cinder blocks in accordance with <br /> Section 13 of our last-approved October 19, 1990 ventilation <br /> plan. Mobile equipment will be used to facilitate sealing the <br /> portals selected for back filling. Other site specific <br /> portals shall be sealed as described below. <br /> 5 .1 The two portals of 2nd South, of the former Dutch Creek <br /> No. 2 Mine (5834 and #35) , can be accessed on foot. <br /> Access will be accomplished by constructing an overland <br /> trail from portals of 1st South (;36 and #35) . The trail <br /> will follow the contact between the Rollins middle <br /> sandstone member and the Coal Basin M Bed. Portals #34 <br /> and #35 will be sealed utilizing cinder blocks in <br />
