I hope <br /> the enclosed information answers your questions. <br /> You first requested clarification of the status of NOV C-93-096 <br /> regarding the stability of the foundation of the old refuse pile <br /> near Dutch Creek. A modification of that NOV incorporated a <br /> citation for failure to assure the stability of the foundation and <br /> abutment of the refuse pile. The required abatement was to revise <br /> the permit to address reinforcing the toe of the slope and moving <br /> Dutch Creek away from the slope and, to implement the revised <br /> plans. <br /> The violation was partially abated when the Division approved MR-43 <br /> on September 27, 1993. This revision called for placement of <br /> riprap along the outer bank of Dutch Creek in the area of concern. <br /> The revision included permission from the Army Corps of Engineers <br /> for placement of riprap along the stream bank. In the Corps' <br /> approval letter, they also suggested a more permanent solution be <br /> considered, such as relocation of the stream channel. Based upon <br /> staff observations which have been noted in various inspection <br /> reports and a June 28, 1993 Jim Pendleton memo, DMG will require <br /> relocation of Dutch Creek in the final reclamation of the site. <br /> Following placement of riprap along the Dutch Creek stream bank, as <br /> approved in MR-43, DMG terminated NOV C-93-096 on October 8, 1993. <br /> The stream bank reinforcement should serve to stabilize that <br /> portion of the channel until it is relocated during final <br /> reclamation. Potential relocation of the stream channel is a much <br /> more complex engineering task which needs to be considered beyond <br /> the scope of NOV abatement and the attendant time frames. As <br /> discussed at our December 14, 1993 meeting, we will work with the <br /> OSM to devise a final location and configuration of the stream. <br /> I mentioned to you over the phone this morning that, based upon an <br /> assessment conference for this NOV, the conference officer <br /> indicated she would recommend modifying the NOV to remove the <br /> citation for failure to stabilize the foundation of the old refuse <br />
