RE: OSM Solicitor Meeting
Today, Cheryl Linden and myself met with Deann Owen regarding the Mid-Continent case.
Ms. Linden and Ms. Owen discussed at some length State and OSM concerns about the
Mid-Continent liquidation plan. Ms. Linden will endeavor to incorporate the OSM concerns into
any response which the State may provide.
During the course of the meeting, I asked Ms. Owen a number of specific questions regarding
the OSM involvement in the Mid-Continent case. I specifically asked who in the OSM was in a
position to make decisions regarding the filing of a personal liability suit, who was the
Albuquerque Field Office responding to in putting the new bond estimate together, who does
Ms. Owen respond to in this matter, who will decide the OSM course of action in the future,
and how the State could obtain a copy of the bond calculation instead of just the summary sheet.
Ms. Owen responded that in each case she was unaware of who was responsible or who we
should contact. Ms. Owen did indicate, however, that the OSM will be conducting a number of
meetings over the course of the next two weeks to sort out their strategies.
In response to this, I requested that the State be informed of any potential legal moves or, at
least, informed of their strategy so that the agencies ensure that they are working toward the
same goals without undermining each other. I cited the fact that we became aware of the new
bond calculation through a newspaper article. Ms. Owen assured me that the OSM would let the
State know what it intended to do in advance.
I tried to impress upon Ms. Owen that the State and OSM need to focus on the outcome of a
reclaimed mine site, and that this was our primary goal. I expressed concern that the
relationship between the agencies had deteriorated remarkably over this matter recently. In this
vein, I pledged out support and cooperation in accomplishing whatever was necessary to ensure
that adequate funds be made available in order that the site can be reclaimed.
