("MCR") <br /> Dear Cheryl: <br /> I am writing in response to your letter of November 6, <br /> 1995. MCR is disappointed that the DMG chose not to respond <br /> favorably to MCR•a proposal to borrow funds from Sanwa Business <br /> Credit corporation. The loan would have funded the balance of <br /> reclamation paymenta due under MCRfs confirmed Bankruptcy plan. <br /> The purpose of the proposed loan, was to eliminate uncertainties as <br /> to the timing of sales of MCR's property, thereby assuring the <br /> timely completion of reclamation activity, <br /> Your latter states that MCRIs proposal to borrow funds <br /> from Sanwa is based on MCR1a development of the mine site for <br /> residential and recreational use, that local approval for this <br /> development has not been obtained and will not be obtained for some <br /> time; and that it therefore ' is "premature for the Division to <br /> evaluate whether changes to the reclamation plan can be made to <br /> accommodate the development plan, . . . The Division cannot agree <br /> to change reclamation requirements based on a proposed development <br /> plan that may change in the future or may not be approved by the <br /> county. " <br /> I want to briefly discuss the development of the mine <br /> site, because there is some apparent confusion regarding the need <br /> for local approval of a development plan.
