Bucknam
Program Supervisor
Colorado Inactive Mine Program
Division of Minerals and Geology, State of Colorado
1313 Sherman Street, Room 215
Denver, CO 80203
Re: Mid-Continent Resources
Dear Mr. Bucknam:
Enclosed are recent articles from our local newspapers. The
next Task Force meeting is on January 10, 1995 at 7: 00 P.M.
at the Redstone Inn. It appears in February our Caucus is
going to have a vote on what it believes would be best for
the future of the 400+ acres in Coal Basin. One alternative
being considered is Mid-Con's development plan. Other
alternatives include open space and purchase by the Forest
Service (by trade, as with the 5800 acres) . An important
consideration for many of us is to what extent there is
going to be funding for the reclamation remaining to be
done, and what the extent of the remaining reclamation will
be.
I respectfully request that you or a knowledgeable DMG
person, and/or Cheryl Linden or a knowledgeable person from
the Attorney General's office, come to our January 10
meeting and advise us concerning these matters.
In the event this can't be done, I ask that you answer the
following questions: Did DMG recently turn down a Mid-Con
offer to pay the reclamation costs up front? If so, why?
Were there conditions attached to this offer which DMG could
not agree to? If so, what were they and why couldn't they be
agreed to? Do DMG and Mid-Con agree on the total amount due
DMG out of the liquidation plan? If not, what are the
differences? Why haven't the Rail Loadout site near
Carbondale and the Coke Oven site near Redstone been put up
for sale, per the April, 1994 liquidation plan? Can't DMG
ask the bankruptcy court to order that these properties be
sold now, so as to produce funds for reclamation? The Mid-
Con lawyer's (Holden' s) 1/24/94 memo said these two
properties were worth $925, 000. 00 at that time. Also, why
can't you ask the court to require that the 400+ acres be
sold now to fund the reclamation? The Forest Service has
indicated that if trades are arranged they can pay for it
1
