Box 25367 <br /> Denver, Colorado 80225-0367 <br /> Re: Dutch Creek Mine, MSHA ID No. 05-00301, <br /> Sealing of Portals <br /> Dear Mr. Holgate: <br /> In reference to your letter of October 19, 1992, rejecting <br /> our letter and sealing plan submitted to you on October 6, 1992, <br /> please consider the enclosed revised plan, and also the following: <br /> 1. It is our understanding that no mine can be <br /> considered Officially abandoned until the <br /> Secretary is so notified in accordance with 30 <br /> C.F.R. g 75. 1204. This was done by my letter to <br /> You dated October 6, 1992. We find nothing in <br /> the Act or the regulations which ties <br /> abandonment in accordance with this section with <br /> employment of miners, any other activity or lack <br /> thereof, or even sealing. <br /> As you are aware, the three B bed mines (L. S. <br /> Wood Mine, MSHA ID No. 05-00300; Bear Creek <br /> Mine, MSHA ID No. 05-00310; and Coal Basin Mine, <br /> MSHA ID No. 05-02342) were idled at various <br /> times from 1979 through 1985 due to conditions <br /> of the coal market. At no time prior to the <br /> cessation of operations in January of 1991 did, <br /> Mid-Continent consider these operations <br /> "permanently closed" or "abandoned. " As you are <br /> aware the L. S. Wood Mine was reopened and mined <br /> for a period in the mid-1980s. Considering the <br /> continuing lack of satisfactory coal market and <br /> the difficult mining conditions, the Bear Creek <br /> Mine was sealed in 1990. However, because of <br /> the potential of the slopes as part of a revised <br /> ventilation system for a large B-bed operation <br />
