cause significant erosion of the north facing slope of the Old <br /> Refuse Pile. Although responsibility for maintaining this and all <br /> other NPDES points lies with Resources, monitoring of this point by <br /> Division personnel is warranted. <br /> Dutch Creek, in the vicinities of the lower (M) coal stockpile and <br /> of the warehouse, is encroaching upon the embankments of two ponds <br /> located at these areas. In the fall of 1995, Resources placed <br /> large rip rap to protect the warehouse pond embankment from further <br /> erosion. Both embankments should be monitored during run off for <br /> signs of failure. If such signs are detected, Resources and <br /> Department of Public Health and Environment will be notified. <br /> Demolition Contract <br /> The demolition contractor, A. M. King Industries, requested in <br /> early December, 1996 that Resources agree that all of the <br /> demolition and salvage operations had been performed to the <br /> specifications of the salvage contract which binds those parties. <br /> Coincidentally, immediately prior to this request being made, the <br /> Division informed Resources of its concern that large volumes of <br /> metallic debris intermixed with concrete rubble in the vicinity of <br /> the wash plant required removal from the site prior to reclamation <br /> being initiated. Subsequent to this notification, the Division <br /> informally notified Resources of other salvage related concerns at <br /> the site. Specifically, small amounts of steel remained to be <br /> removed at the Rock Tunnel area, guard rails on Roads C, D and E <br /> required removal, miscellaneous scrap requiring removal remains in <br /> place at the upper (B) coal stockpile, the old truck dump area, the <br /> warehouse area, the wash plant vicinity and at the office area. <br /> Also, power poles and many miles of telephone and power cables <br /> still in place throughout Coal Basin require removal. <br /> Although it is reported that Resources denied Kings' request, no <br /> formal notification of such a determination by Resources has been <br /> sent to the Division. <br /> There exists the possibility that the demolition contractor will <br /> not return to the site in 1997 to conclude the remaining salvage <br /> operations. Representatives of Resources have indicated that they <br /> hold a fifty to sixty thousand dollar retainer, which they stated <br /> would be used to finish the salvage work should the contractor not <br /> return to the site. <br /> Should salvage work not be concluded prior to the start of 1997 <br /> reclamation construction, Division contractors would be minimally <br /> impacted. The amount of scrap remaining at 1997 project locations <br /> is relatively small. Material remaining at the stockpiles and at <br /> the warehouse could be transported to the wash plant area by <br /> Division contractors. Expenses incurred would have to be deducted <br /> from the salvage credit previously extended to Resources.
